Japanese Nanotech Contact Name Lists

Purchaser of this contract list hereby agrees:

• Purchase is for rental usage rights only.
• All these names are the exclusive property of Bionanome and may not be sold, rented, shared, duplicated or given to anyone else at all in any format whatsoever. They may only be used by the actual purchaser (or their marketing agency) for their own sales and marketing purposes.
• The Renter will not acquire any ownership rights in the names other than the right to use the list multiple times for their own sales or marketing campaigns. Renter shall be personally held responsible for any additional usage or disposition without authorization will be subject to legal sanctions and penalties, which shall be no less than triple the actual costs paid for the list. Anyone attempting to resell these lists in any format whatsoever shall also be liable for additional business sanctions equal to at least ten times the cost of renting the list.
• While every effort has been made to check these names as carefully as possible, Renter understands that such lists are always subject to a certain error rate because people move offices and jobs. However, Bionanome will issue a credit at the rate of $.60 per name for all names that are undeliverable by the Japanese Post Office. Such claim lists shall be emailed to Bionanome for reimbursement within 120 days of the original purchase date.
• Bionanome makes no warranties as to the accuracy of the data or the suitability of this list for any specific application. Furthermore, quantity counts are approximated, though the actual number of contact records is always in excess of the number of names quoted. The number of records with phone and email entries is always quoted as an approximate percentage.
• This purchase includes free updates of names for a period of one year after the date of purchase. While Bionanome does not guarantee any significant updates will be made (or any at all), that shall be their intent. Announcements of such updates, along with contact counts, will be sent to all purchasers. The update records will only be provided to those who respond to such announcements. The frequency of updates will be quarterly at best.
